Recent Qui Tam News

The U.S. Department of Justice reported recovering a record amount of more than $3.1 billion in settlements and judgments in cases relating to fraud against the government for the fiscal year ending September 30, 2006.  Since Congress amended the False Claims Act in 1986, the Justice Department has recovered $18 billion from companies and individuals who commit fraud on the government.  The healthcare industry represents the largest amount of fraud uncovered.  The Justice Department reported that in 2006, 72% of the recoveries were in healthcare, 20% was in procurement and 8% was in other areas. Recent Awards and Settlements*

  • American Medical Response pays $9,000,000 to settle fraud case which alleged that the ambulance company provided illegal inducements to hospitals in Texas in exchange for referrals.  October 5, 2006.
  • Horizon West Inc. & Horizon West Healthcare Inc. agreed to pay $14,700,000 to settle false claims case alleging the company falsely inflated the number of nursing hours spent on Medicare patients when reporting their costs to Medicare from 1991 to 1998.  September 26, 2006.
  • Beverly Enterprises Inc. pays $20,000,000 to settle false claims case alleging the companies former subsidiary submitted false claims for payment to Medicare and Medi-Cal for Durable Medical Equipment provided to the programs’ beneficiaries without obtaining the proper claims and medical documentation.  August 18, 2006.
  • Medtronic pays $40,000,000 to settle false claims allegations that its Medtronic Sofamor Danek division paid kickbacks to doctors to induce them to use MSD’s spinal products.  July 18, 2006.
  • Mario Gabelli & Affiliate pay $130,000,000 to settle fraud alleged by a scheme over the course of eight Federal Communications Commission auctions from 1995 to 2000.  July 13, 2006.
