Patents

A patent is a specialized form of intellectual property. Unlike copyrights, which prevent copying, a patent is essentially a contract that empowers the owner to exclude others from making, using, selling or importing the claimed inventions. An intellectual property lawyer can help an inventor to protect his or her creation from exploitation through the use of patents, and, if necessary, patent litigation.

There are three key types of patents:

  • A utility patent is the most common and effective type of patent. This can cover machines, processes or other inventions. The patent can cover all aspects of the invention.
  • A design patent is much easier to obtain, but covers only the appearance and aesthetics of an invention.
  • A plant patent offers very specific protection to those who have created and reproduced very specific kinds of plants.
